If you prefer to order your order, you can make an appointment here. Pre-ordering an order works time-saving and can still be purchased on-site. The minimum amount for collection orders is € 50, - (Excl. VAT)
Delivery of the order
Minimum order for free delivery
€ 200, - (excluding VAT). Plants alone i.c.m. fishing. For orders below € 200, - € 20, - will be charged. Orders under € 150, - are not delivered.
We give 2% discount on cash or direct debit.
Shipping is done in polystyrene boxes. In winter we use "heatpacks" (€ 0.65 each). Please return the polystyrene boxes at the next delivery. Frozen orders can be made from 15 blisters. This prevents thawing and efficient use of packaging material.
1.1. These terms and conditions are part of any agreement as well as the execution thereof, whereby an agreement has been entered into through Aqua Quality and acts as a seller against a buyer.
1.2. Website https://www.aquaqualitystore.com is part of Aqua Quality Nijmegen, which is based and based at Tarweweg 1 D, 6534 AM in Nijmegen.
1.3. Aqua Quality offers services related to and selling and supplying fish and related articles throughout the Netherlands, Belgium and Germany with the exception of the Wadden Islands.

1.5. Changes to the agreement between the seller and the buyer and deviations from these general terms and conditions of sale will be effective only if they have been agreed in writing between the seller and the buyer.
1.6. Aqua Quality reserves the right to change and / or supplement these Terms and Conditions.
2.1 Where these terms are termed "buyer", this means a counterparty of the Web Store Aqua Quality, a natural person, partnership, company or legal person who has commissioned a service through the Website.

Offers and agreement
3.1 Offers or pricing via the Website should be considered as invitations to potential buyers to make an offer. Aqua Quality is by no means bound to such offers or quotes or any offer from potential buyers unless written and unambiguous. Acceptance of an offer to make an offer by the potential Buyer applies as an offer and leads to the conclusion of an agreement only if the other stipulated in this article is met.

3.4 All prices are expressed in Euros, in accordance with the legal requirements in this regard, and include sales tax. The Purchaser shall pay the price that Aqua Quality has notified to her in its confirmation pursuant to Article 2.3 of these Terms. 3.7 Depending on the order size expressed in Euros, ordering costs may be charged. These are reflected in the total amount including sales tax.
3.8 It may occur that the ordered products are not in stock on the day of delivery. The buyer will disclose this to the customer one day before delivery via the phone number entered in the agreement

At that time, the buyer is entitled to a refund of the amount of the contract including delivery costs. In the second case, Article 4.6 of these terms and conditions is equal and the buyer is entitled to a refund of the value of the missing goods mentioned in the agreement.
3.9 If an agreement has been made in accordance with article 3.3, the buyer can no longer change or cancel an order.
3.10 The additional ordering of new products always leads to a new order with the ordering costs in force. Also in case of replacement orders resulting from events mentioned in article 3.8.
3.11 The period of refusal referred to in article 7: 46d paragraph 1 Civil Code does not apply, as it concerns matters that can spoil or age soon as referred to in article 7: 46d paragraph 4 of 4 Civil Code.
Delivery and delivery time
4.1 Orders are delivered by Aqua Quality to the address entered in the agreement by the buyer within the Aqua Quality delivery area.
4.2 If the buyer's order is entered before 12:00 in the afternoon, delivery may take place within 1 - 5 days.
4.3 One day before delivery, an email will be sent around 16:00 with the message within which block the order will be delivered. A block is a three-hour period specified in the notification.
4.4 The time specified by Aqua Quality is an indication, which can not be derived from any rights.
4.5 Approximately half an hour before the Aqua Quality Driver is at the address, he will contact the telephone number specified in the agreement or invoice.
4.6 Immediately after receipt, Buyer must check the products. Any differences noted with the order should be reported to the driver immediately. The driver will make a note on the coupon and initiate this. The seller is then entitled to a refund of the value of the missing property mentioned in the agreement
4.7 If at the intended time of delivery by the driver, neither the Buyer nor any person designated by him at the delivery address or the Buyer or the above-mentioned designated person can not or can not receive the package, then Aqua Quality will be available from that moment no longer guarantees the good temperature of the contents of the package. In such a case, the driver will, if possible, issue the package to the neighbors or neighbors, and otherwise the driver will take back the order. 4.8 If the driver returns the order, the buyer will still be able to obtain the order at the address of Aqua Quality in Nijmegen. The Buyer can do this the following day in consultation with Aqua Quality. Thereafter all claims of the buyer relating to the agreement shall be voided, including the right to refund the amount paid by the buyer.
5.1 The seller is entitled to suspend the delivery of the purchases purchased by the buyer, if a direct or indirect consequence of one or more of Article 5.3. stated reasons - whether or not they could be provided at the time of the conclusion of the agreement - reasonably, the cases can not be delivered or not delivered in time.

6.2 If the driver is still present if the defect is detected, a sample of the product will be taken back for examination.
6.3 The buyer is obliged to keep the products available for a reasonable period of time but at least 5 days at the disposal of the seller and to take all the care that may reasonably be required of him for the quality observed with to keep the episode constant. 6.4 If the seller decides the complaint, the buyer is entitled to a refund of the value of the recurring goods as stated in the agreement.

6.6 Returns by the buyer are only allowed if the seller has expressly given prior written consent.
7.1 Aqua Quality is never liable for any indirect damage caused by the Purchaser or third parties, including consequential loss, business damage, delay damage, loss of profits or injury, or any other indirect damage, for any reason whatsoever and by any person.
7.2 The Buyer indemnifies Aqua Quality for all claims by third parties, for any reason, in respect of compensation for damage, costs and / or interest caused by, incidental to or in any way related to the cases provided by us quo our performance performance.
7.3 If the seller is liable for the seller due to a defective delivery, the compensation payable by the seller shall be limited to the amount of the purchase price of the goods delivered.

10.1 Any dispute arising from the agreement or further agreement concluded between the seller and the buyer, including the collection of a claim, shall be subject to the sole judgment of the competent Dutch court in the Utrecht District Court, except for those disputes which belong to the district court jurisdiction.
10.2 The explanation according to the Dutch version of these terms and conditions is binding.
